2. APPLICABILITY

2.1 These Terms apply to every offer made through the Musthavvy webshop and to every agreement concluded between Musthavvy and a consumer.

2.2 These Terms are made available before or at the time an order is placed and can be viewed and stored electronically.

2.3 Where additional product-specific conditions apply, those conditions form part of the agreement.

2.4 If any provision in these Terms conflicts with mandatory consumer law, the mandatory legal provision applies.

3. PRODUCTS AND PRODUCT INFORMATION

3.1 Musthavvy aims to describe and display all products as accurately as reasonably possible.

3.2 Colours, packaging, handmade details and other visual characteristics may differ slightly from photographs shown on the website.

3.3 Obvious errors, technical mistakes or clear pricing mistakes do not bind Musthavvy.

3.4 Products are offered subject to availability.

3.5 If a product unexpectedly becomes unavailable after an order has been placed, Musthavvy will contact the customer and, where appropriate, offer an alternative or refund the amount paid for the unavailable product.

4. ORDERS AND FORMATION OF THE AGREEMENT

4.1 The customer places an order by completing the checkout process.

4.2 The agreement is concluded when Musthavvy confirms the order electronically.

4.3 Musthavvy may refuse or cancel an order where there are reasonable grounds to suspect fraud, misuse, a technical error, an obvious pricing error or another unlawful or improper use of the webshop.

4.4 If Musthavvy cancels an order after payment has already been received, the applicable amount will be refunded.

5. PRICES

5.1 Product prices are shown including VAT where applicable.

5.2 Shipping costs are not included in the product price unless explicitly stated otherwise.

5.3 The applicable shipping costs are shown before the customer completes checkout.

5.4 Musthavvy may change prices at any time. Price changes do not affect orders that have already been confirmed.

5.5 In the event of an obvious pricing error, Musthavvy may contact the customer before fulfilling the order. The customer may then choose whether to continue with the corrected price or cancel the order.

6. PAYMENT

6.1 Payments are processed through Shopify’s checkout and payment infrastructure.

6.2 The payment methods available to the customer are shown during checkout and may differ depending on the customer’s location and order.

6.3 Musthavvy may offer payment methods where the full amount is paid in advance.

6.4 Where required by applicable consumer law, Musthavvy will also provide a payment option that complies with the legal requirements concerning advance payment.

6.5 The customer is responsible for providing correct payment information.

6.6 The checkout clearly indicates when placing the order creates a payment obligation.

7. PROCESSING, SHIPPING AND DELIVERY

7.1 Orders are prepared according to the processing times shown on the Musthavvy Shipping page.

7.2 Unless otherwise stated for a particular product, the standard processing time is generally 1–3 business days.

7.3 Processing time is separate from the estimated delivery time.

7.4 Musthavvy currently ships orders using PostNL.

7.5 Shipping costs depend on destination, shipment type and/or order weight and are shown during checkout.

7.6 Tracking information is provided for Musthavvy shipments where applicable.

7.7 The customer is responsible for entering a correct delivery address during checkout.

7.8 If the customer notices an error in the delivery address, the customer should contact Musthavvy as soon as possible.

7.9 Once an order has been dispatched, Musthavvy cannot guarantee that the delivery address can still be changed.

7.10 The risk of loss or damage remains with Musthavvy until the order has been delivered to the customer or to a third party designated by the customer, unless applicable law provides otherwise.

7.11 If a parcel appears to be delayed or lost, the customer should contact Musthavvy so that the shipment can be investigated with the carrier.

8. RIGHT OF WITHDRAWAL

8.1 For products covered by the statutory right of withdrawal, a consumer may withdraw from the purchase without giving a reason within 14 days after receiving the product.

8.2 If one order is delivered in several separate shipments, the withdrawal period starts after receipt of the final product or shipment where required by law.

8.3 The customer may exercise the right of withdrawal through Musthavvy’s online return or withdrawal function or by another clear statement informing Musthavvy of the decision to withdraw.

8.4 The customer does not have to provide a reason for exercising the statutory right of withdrawal.

8.5 After notifying Musthavvy of the withdrawal, the customer must return the relevant product within 14 days.

8.6 The customer bears the direct cost of returning a product where this was clearly communicated before purchase, except where the return concerns an incorrect, defective or otherwise non-conforming product for which Musthavvy is responsible.

9. CONDITION OF RETURNED PRODUCTS

9.1 During the withdrawal period, the customer should handle the product and its packaging with care.

9.2 The customer may inspect the product only to the extent reasonably necessary to establish its nature, characteristics and functioning.

9.3 Where a product has lost value because it has been handled beyond what was necessary for such inspection, Musthavvy may deduct the resulting depreciation where permitted by law.

9.4 Returned products should be complete and properly packaged.

9.5 Where reasonably possible, the customer should use the original product packaging or equivalent protective packaging.

10. REFUNDS

10.1 Where the customer validly exercises a statutory right of withdrawal, Musthavvy will refund the amounts that must legally be refunded.

10.2 If the entire order is withdrawn, the refund includes the standard outbound delivery costs originally paid by the customer.

10.3 If the customer selected a more expensive delivery option than Musthavvy’s least expensive standard delivery option, Musthavvy is not required to refund the additional cost of that more expensive option.

10.4 If only part of an order is returned, the original outbound shipping costs do not have to be refunded unless otherwise required by law.

10.5 Refunds will be made within the legal refund period.

10.6 Musthavvy may wait with the refund until the returned products have been received or until the customer provides evidence that the products have been returned, whichever occurs first.

10.7 Refunds are made using the same payment method used for the original transaction unless the customer expressly agrees to another refund method.

11. ONLINE RETURNS

11.1 Musthavvy offers an online function through which customers can start an eligible return or exercise the right of withdrawal.

11.2 Where required by law, the customer is not required to create a new account solely in order to exercise the statutory right of withdrawal.

11.3 Musthavvy may request information that is reasonably necessary to identify the relevant order.

11.4 After an online withdrawal request has been submitted, confirmation will be provided where required.

12. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

12.1 The statutory right of withdrawal does not apply where a statutory exception applies.

12.2 This may include products that are manufactured according to the customer’s specifications or that are clearly personalised, provided that the legal requirements for the relevant exception are met.

12.3 Any product-specific exclusion from the right of withdrawal will be clearly communicated before purchase where required.

13. BLIND DATE WITH A BOOK

13.1 A Blind Date With a Book is individually matched and prepared using information provided by the customer through the Musthavvy Matchmaker.

13.2 This information may include reading preferences, genres, tropes, reading history and a list of books the customer already owns or has read.

13.3 The customer is responsible for providing complete and accurate Matchmaker information at the time of ordering.

13.4 Musthavvy can only take account of books and preferences that were actually provided before the match was selected.

13.5 If the customer receives a title that was not included in the reading information submitted with the order, this is not regarded as an incorrect duplicate match solely because the customer already owns or has read that title.

13.6 If the customer believes a title was clearly included in the submitted reading list, the customer should contact Musthavvy so that the information submitted with the order can be checked.

13.7 Where a Blind Date return is accepted, the product must be unread, unused and complete.

13.8 Musthavvy may offer store credit for Blind Date returns under its voluntary Blind Date return policy.

13.9 Any voluntary store-credit arrangement does not replace or restrict a statutory right to a monetary refund where such a right applies under mandatory consumer law.

14. MINI BOOKS

14.1 Musthavvy may offer Mini Books in different designs, covers, quantities and combinations.

14.2 The available choices and applicable price are shown on the relevant product page or during the ordering process.

14.3 Volume discounts may apply depending on the quantity ordered.

14.4 The final price is shown before the order is completed.

14.5 Where a Mini Book is made according to customer specifications or is clearly personalised for the customer, the statutory right of withdrawal may be excluded where the legal conditions for that exception are met.

14.6 Where the statutory right of withdrawal does not apply to a personalised Mini Book, this will be clearly communicated before purchase.

15. BOOK JOURNALS, INSERTS AND OTHER PRODUCTS

15.1 Standard Book Journals, inserts, bookmarks, bags, glasses and other non-personalised products are subject to the ordinary return rules unless a statutory exception applies.

15.2 The fact that a standard product is printed, assembled or prepared after an order is placed does not by itself mean that the product is excluded from the statutory right of withdrawal.

16. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

16.1 Products must conform to the agreement and may reasonably be expected to match the description provided.

16.2 If an item arrives damaged, incomplete, defective or incorrect, the customer should contact Musthavvy as soon as reasonably possible.

16.3 The customer should contact Musthavvy before sending a defective or incorrectly delivered product back as a normal paid return.

16.4 Where Musthavvy is responsible for the problem, Musthavvy will arrange an appropriate solution in accordance with applicable consumer law.

16.5 Depending on the circumstances, this may include repair, replacement, refund or another appropriate remedy.

16.6 The customer’s statutory warranty and conformity rights are not limited by these Terms.

17. CUSTOMER ACCOUNTS

17.1 Shopify customer accounts may be used to view orders, access account information and use self-service return functionality.

17.2 Customers are responsible for maintaining secure access to the email account used for their Musthavvy customer account.

17.3 Musthavvy may restrict account access where reasonably necessary to protect the customer, Musthavvy or the webshop against fraud, misuse or security risks.

18. WISHLIST

18.1 Musthavvy may provide wishlist functionality through Wishlist by Square or another Shopify-integrated service.

18.2 Wishlist functionality is provided as an optional convenience and may be changed, interrupted or removed.

18.3 Wishlist activity may be processed in accordance with Musthavvy’s Privacy & Cookies information.

19. INTELLECTUAL PROPERTY

19.1 The Musthavvy name, branding, logos, website design, written content, graphics, photographs, original product designs and other original creative materials belong to Musthavvy or its licensors.

19.2 These materials may not be reproduced, distributed, sold, commercially exploited or otherwise used without prior permission, except where use is legally permitted.

19.3 Buying a Musthavvy product does not transfer intellectual-property rights in Musthavvy designs, branding or content to the customer.

20. DISCOUNTS, PROMOTIONS, STORE CREDIT AND VOUCHERS

20.1 Promotional offers and discount codes may be subject to additional conditions.

20.2 Unless stated otherwise, discounts cannot be exchanged for cash.

20.3 Musthavvy may limit a promotion to selected products, a specific period, a minimum order value or a limited number of uses where this is clearly communicated.

20.4 Store credit and vouchers may be used subject to the conditions shown when they are issued.

20.5 Statutory refunds will not be converted into store credit without the customer’s agreement where applicable law requires reimbursement using the original payment method.

21. PRIVACY

21.1 Personal information is handled according to Musthavvy’s Privacy & Cookies information.

21.2 The Musthavvy webshop is powered by Shopify and uses Shopify’s infrastructure for relevant webshop, checkout, payment, account and privacy functions.

21.3 More information is available on the Musthavvy Privacy & Cookies page.

22. COMPLAINTS

22.1 If the customer has a complaint about an order, product or service, the customer may contact Musthavvy at:

complaints@musthavvy.com

22.2 The customer should describe the complaint as clearly as reasonably possible and include information needed to identify the relevant order.

22.3 Musthavvy aims to respond to complaints within 14 days after receipt.

22.4 If a complaint requires more time to investigate, Musthavvy will provide an acknowledgement within that period and indicate when a more detailed response can reasonably be expected.

23. CHANGES TO THESE TERMS

23.1 Musthavvy may update these Terms where necessary because of changes to the webshop, products, services, business practices or applicable laws.

23.2 Changes apply to future orders from the date the updated Terms are published unless otherwise required by law.

23.3 The Terms applicable to an existing order are generally the Terms that were in force when that order was placed.

24. SEVERABILITY

24.1 If one provision of these Terms is invalid, unenforceable or contrary to mandatory law, the remaining provisions remain in force.

24.2 Where legally possible, the invalid provision will be interpreted or replaced in a manner that most closely reflects its lawful purpose.

25. GOVERNING LAW

25.1 These Terms and agreements with Musthavvy are governed by Dutch law.

25.2 This choice of law does not deprive consumers living in another country of mandatory consumer protections that apply to them under applicable law.
